Statement by Owner of Ukrlandfarming Oleg Bakhmatyuk: Judgement Restores Justice, Kasko’s Decision to Reopen Case Against Me Is Unlawful and Subject to Reversal
On 5 June, the Pechersk District Court of the City of Kiev handed down a ruling reversing the unlawful decision by Vitaliy Kasko, a former deputy of Prosecutor General Ryaboshapka. This unlawful decision to open a criminal case against me personally and my company was signed by Kasko following a direct order by Andriy Bohdan. We have stated repeatedly that the decision was issued by Kaso in breach of all norms and principles of law. This was also confirmed by a number of leading experts in their respective opinions. At last, the court has dotted all the i’s and cross all the t’s over this matter and stopped this iniquity – the ruling is final and not subject to appeal.
Political motivation was evidently behind Kasko’s decision. It was about persecuting and putting pressure on me and my company by a group of people abusing office in pursuit of their own rather than the public interest. This decision was produced by Kasko who colluded with the former Head of the Office of the President of Ukraine, Bohdan, and NABU Director Artem Sytnyk driven by personal vengeance. This unlawful decision by Kasko held hostage a large company, which is important to the national economy; it employs 27,000 Ukrainians, has contributed over the past three years UAH 7.7 billion in taxes, and generates 1% of the national GDP.
The court has spoken: Kasko’s decision is unlawful and subject to immediate reversal. I hope the Prosecutor General will also finally dot all the i’s and cross all the t’s over this matter by approving a fair and impartial decision, free from any pressure on the part of the aforementioned individuals, who are trying to cover up their unlawful acts by abusing public office. Such a lawful decision by the Prosecutor General would enable the company to live, work, pay taxes and create jobs here in Ukraine. Such a decision would enable businesses and government to reach an agreement and act in the public interest, and not in the interests of either Mr Kasko or Mr Bohdan or Mr Sytnyk, who were never guided by the public interest but pursued solely their own vested interests. By complying with the court ruling, the Prosecutor General will restore justice and prevent the destruction of a major employer, major taxpayer, a company creating Ukrainian products and playing an important role as part of Ukraine’s national economy.
